These Terms of Service set out the basis on which Barton Notary provides notarial services. Our scope of work includes the authentication and execution of legal documents, reliance on information provided by the client, and adherence to professional standards.

Barton Notary is regulated pursuant to the Legal Services Act 2007 by the Master of the Faculties through the Faculty Office of the Archbishop of Canterbury.

Client Responsibilities
Accurate Information
Clients must provide complete and accurate information relevant to the notarial act. The notary relies on the truthfulness of these details for the authentication process.
Original Documents
Unless otherwise agreed, clients must produce original documents for inspection. Photocopies or digital scans are generally not sufficient for notarisation unless verified against the original.
Valid Identification
Clients are required to provide valid, government-issued photo identification, and recent proof of address, to comply with anti-money laundering and regulatory requirements.
In-person Attendance
Where required by law or specified by the notary, clients must attend appointments in person to witness the execution of documents and confirm their understanding of the transaction.
Clients must also notify the notary of any specific deadlines or unique requirements from the receiving jurisdiction to ensure the notarial act is completed effectively and within the necessary timeframe.

Barton Notary’s privacy notice explains we collect and use clients personal data to provide notarial services, carry out identity checks, meet legal obligations, and operate our website. We may share data with service providers, public authorities, and foreign organisations where needed, including for international matters. The notice also explains how long data may be kept, how cookies are used, and the rights our clients have over their personal data, including the right to complain to Barton Notary or the ICO.

Barton Notary's Anti-Money Laundering Policy exists to set out our anti-money laundering and counter-terrorist financing policies, controls and procedures, and to explain how these obligations are applied in practice. It provides a clear framework for identifying, assessing and managing risk, helps ensure compliance with legal and regulatory duties, and supports a consistent and transparent approach to client due diligence, record keeping and reporting.

We comply with our regulators Code of Practice which outlines how Notary Public practices must be guarded against the risks of money laundering. You can read more here.
We use AI to support our services in a way that is responsible, secure, and transparent. This means we apply appropriate oversight, protect client confidentiality and personal information, assess risks carefully, and stay open with customers about if and how AI is used.

Our notary services are also protected by your statutory rights under the Consumer Rights Act 2015, which means you are entitled to services that are carried out with reasonable care and skill, within a reasonable time, and for a fair price. You will also see reference to the Consumer Rights Act within our Terms & Conditions.

We hold professional indemnity insurance valued at £1000,000.00, and we hold public liability insurance. This is in line with the requirements laid out by our regulator, the Faculty Office of the Archbishop of Canterbury.

Complaints Procedure
Barton Notary aims to provide all clients with an efficient and professional service. However, if you are not satisfied with the service you have received, please contact us immediately. We will investigate the concern internally in accordance with our complaints handling procedure and will endeavor to resolve the matter promptly and fairly.
If the complaint cannot be resolved through our internal process, you may refer the matter to the Notaries Society of which Matthew Barton is a member. As a notary public regulated by the Faculty Office of the Archbishop of Canterbury, clients also have access to the Approved Regulator's complaints process.
